This document sets out the terms and conditions of use of this website (hereinafter, the "Terms of Use"), the owner of which is HARTING Iberia, S.A.U. (hereinafter, "HARTING Iberia"), a company incorporated and existing under Spanish law, with registered office at C/Viriato, 47 8th floor Edificio Numancia 1, and NIF A59367581. When a natural person or legal entity (through its legal representative) - the "Customer" - accesses and uses the HARTING Iberia website at https://www.harting.com/es-ES (hereinafter the "Website") accepts these Terms of Use.

The Customer must read these Terms of Use carefully before accessing, using and/or registering an account on the Website or subscribing to/applying for any of HARTING Iberia's products and services.

HARTING Iberia reserves the right to modify the Terms of Use at any time and without prior notice. The amended Terms of Use shall be integrated into this document from time to time and shall be binding as of the date they are updated and published on the Website.

2. Intellectual property rights

The content of this Website includes, but is not limited to, works, images, photos, dialogues, music, sounds, videos, documents, drawings, figures, logos and any other material, including menus, web pages, graphics, colours, diagrams, tools, fonts and Website design, diagrams, schematics, methods, processes, functions and software which form part of the Website and which are protected by copyright and all other intellectual property rights of HARTING Iberia and its Licensors (all rights reserved).

Except as provided herein, nothing in these Terms shall be construed or interpreted as conferring upon you or any third party any right (proprietary, license, usage or otherwise) with respect to or in connection with the HARTING Iberia content, nor shall any right or license be granted to you by any means to use the content.

The Website presents products and discloses product information at the discretion of HARTING Iberia. The presentation of this information does not create any warranty of any kind. To the full extent permitted by applicable law, HARTING Iberia shall not be liable for any damages resulting from the inaccessibility of the Website services or damages caused by viruses, corrupted files, errors, omissions, service interruptions, deletion of content, problems with the network, with suppliers or telephone connections and/or data transmission, unauthorised access, alteration of data, failure and/or malfunction of the Customer's electronic equipment.

The Customer expressly agrees that the Customer's use of the Website and its content is at the Customer's own discretion and risk.

HARTING Iberia reserves the right to modify, withdraw or delete any products, services, content or information on the Website at any time and at its sole discretion.

HARTING Iberia shall not be liable for any damages that may arise as a result of the use of the Website including, without limitation, any direct or indirect, loss of profits, special, incidental or consequential damages of any kind and nature whatsoever, known and unknown, suspected or unsuspected, disclosed and/or undisclosed.

The limitations and exclusions contained herein shall be interpreted in accordance with applicable law.

5. Customer registration requirement

The Website may require registration as a precondition to subscribe/purchase the product or service. For this purpose the Customer will be asked complete a Registration Form available on the Website in which certain mandatory fields may need to be entered.

The Customer represents and warrants to HARTING Iberia that all information provided by the Customer upon registration is true, accurate, complete and current at all times.

The Customer must not impersonate or use third party information to proceed with the registration.

Without prejudice to any other remedies available at law, failure by the Customer to comply any of the above obligations may result in the Customer and/or the Customer's organisation, as applicable, being liable for all damages caused to HARTING Iberia and/or injured third parties, as well as the possible expulsion of the Customer from the Website and the cancellation of its pending transactions, without the Customer having any other recourse.

The Customer shall keep the Credentials strictly confidential and shall not show, entrust, deposit or share them with any third party. The Customer is fully responsible for restricting access to any device or medium on which the Credentials are recorded, stored or retained. The Customer agrees to accept responsibility for all activities that occur under the Customer's Credentials on the Web Site or elsewhere. The Customer shall maintain appropriate levels of security and protection of the Credentials and undertakes to inform HARTING Iberia in the event that they are stolen, copied or misused by any person. In such cases, the Customer shall refrain from further use of the Credentials and HARTING Iberia may - but shall not be obliged to - reinstate the Credentials, choose to provide the Customer with different Credentials or remove the Customer from the Website as a registered Customer without any remedy to the Customer.

6. Minors and parental control

The Website is not suitable or intended for persons under 18 (eighteen) years of age and is rated 18+.

Customers who are minors (hereinafter referred to as "Minors") or legally incapacitated may visit and browse the Website under the supervision of their parents or legal guardians. Any interaction of a Minor with the Site shall be considered by HARTING Iberia as supervised activity and interaction of a Minor.

Parents and legal guardians shall remain fully responsible at all times for the Child's online conduct and/or any consequences arising from the Child's unsupervised Internet activity.

7. Applicable Law and Dispute Resolution

These Terms have been drafted and will be interpreted in accordance to the laws of Portugal.

Any claims arising from or in connection with these Terms of Use shall be exclusively submitted and resolved by the Civil Courts of Lisbon (Portugal).
